If you believe you may be under federal or state investigation for mortgage fraud, it is critical to your case that you hire a qualified criminal defense attorney right away. Do not risk having your rights violated by neglecting to retain a skilled, experienced criminal defense attorney.
The Houston, Texas law office of Kuniansky & Associates will work diligently to ensure your rights are protected.
The Federal Bureau of Investigation (FBI) investigates mortgage fraud in two specific areas:
Fraud for Profit, commonly referred to as "Industry Insider Fraud": the motive is to revolve equity, falsely inflate the value of the property, or issue loans based on fictitious properties.
Fraud for Housing represents illegal actions perpetrated solely by the borrower. The simple motive behind this fraud is to acquire and maintain ownership of a house under false pretenses.
The FBI focuses its efforts on fraud perpetrated by industry insiders. Some of the current rising mortgage fraud trends include: equity skimming, property flipping, and mortgage related identity theft.
Since 1999, the FBI has been working to actively investigate mortgage fraud in various cities across the United States. The FBI works closely with individual lenders, as well as national associations such as the MBA, the Appraisal Institute, the National Association of Mortgage Brokers, and the National Notary Association, to define and combat the mortgage fraud problem. In addition, on a case-by-case basis, the FBI receives close cooperation from lenders.
Texas State Mortgage Fraud Laws:
Allegations of mortgage fraud can arise out of inaccuracies on lending documents and mortgage applications, including exaggerated income and assets, false statements about the origin of income and assets, falsified documents, and inflated appraisals. We represent individuals accused of defrauding mortgage companies and lenders because of alleged engagement in all of these activities. We also represent mortgage companies and mortgage brokers accused of defrauding borrowers through inaccurate interest rate and fee representations and failure to disclose essential elements of mortgage loan packages, including mandatory insurance provisions.
Our attorneys also work with homebuilders and contractors to defend against allegations of inflated rates and misleading lenders about work performed.
At the Houston Texas Law Offices of Kuniansky & Associates we represent bank officials, loan officers, loan processors, loan recruiters and promoters, straw buyers, underwriters, account managers, appraisers, mortgage and real estate brokers and agents. Many borrowers have also been indicted based upon the documents they were encouraged to sign in obtaining their loans. Mr. Kuniansky works closely with forensic accountants, financial experts, CPAs and former bank officials in preparing his clients' defense.
